Terms and Conditions of Service

1. Acceptance of Terms

By accessing, registering for, or playing "Swinging Cat", you agree to be bound by these Terms. If you do not agree to all the provisions set forth herein, you are prohibited from using the Service.

2. Age Requirements and Registration

The game offers two access modes, structured to comply with minor privacy regulations (e.g., GDPR):

• Users under 18 years of age: They are not permitted to create an account by providing direct personal data (such as email, password, and nickname). They may exclusively use the 'Play as Guest' mode (Anonymous Access). In this mode, no contact details are requested; however, the underlying infrastructure (Google Firebase) generates a temporary anonymous ID and may process technical data strictly necessary for the operation of the service (such as IP address for network connection), in compliance with our Privacy Policy and without profiling purposes.
• Users aged 18 or older: They may create a registered account to save progress to the cloud and participate in the Global Leaderboard, explicitly declaring under their own responsibility that they have reached the age of majority at the time of registration.

The user guarantees that the information provided at the time of registration is accurate and truthful.

3. Accounts, Scores, and Security

Depending on the chosen account type, different conditions apply to data saving:

• Registered Account: Scores and progress are permanently saved on our servers (Firebase). The user is responsible for maintaining the confidentiality of their account credentials.
• Guest Account (Anonymous): Main gameplay data is saved in the browser's local memory (Local Storage) or associated with a temporary ID. Clearing the browser cache or uninstalling the browser results in the irreversible loss of progress. However, if a Guest user uses the "Multiplayer" mode, an anonymous ID, a username composed of the first four characters of the user's ID ("Player-XXXX"), and the current match score will be temporarily transmitted and saved on our servers to enable match synchronization with other players.

Score Synchronization: For registered users, local scores saved on the device (via Local Storage) are automatically compared and synchronized with the cloud servers (Firestore) upon login or reconnection. If the score saved locally on the device is higher than the score recorded on the cloud, the system will automatically update the record on the server in order to preserve user progress.

4. Global Leaderboard

When using the "Global Leaderboard" features, the user undertakes to:

• Not use hacks, cheats, bots, scripts, or any third-party software to artificially alter their score or manipulate the game.
• Not use usernames (Display Names) that are offensive, racist, discriminatory, vulgar, or that violate the rights of third parties.

To preserve the integrity of the Service, the administration reserves the right to monitor, filter, or periodically invalidate scores that appear clearly anomalous, manipulated, or impossible to achieve through human gameplay timing. If suspicious activity or the use of scripts to alter game data is detected, the system or administrators will disregard non-compliant scores, excluding them from the Global Leaderboard to ensure fair results achieved legitimately. Forced account suspension is not planned, but we disclaim any liability for the removal of records deemed fraudulent.

Users undertake not to choose Nicknames containing offensive or vulgar terms, inciting hatred, or violating third-party rights. As the system does not apply an automatic pre-filter upon account creation, the administration reserves the right to periodically review display names shown on the Global Leaderboard (Top 10).

If a Nickname on the leaderboard is deemed unacceptable or inappropriate:

• The Service Provider will manually modify or reset it to a username composed of the first four characters of the user's ID ("Player-XXXX") to ensure a fair and decent gaming environment.
• The Owner will send a notification to the email address associated with the account to inform the user of the modification.
• To request customization or a change of their modified Nickname, the user may contact customer support at swingingcat26@gmail.com.

To the maximum extent permitted by law, the administration disclaims any liability for the temporary display of indecent, offensive, or non-compliant nicknames prior to their actual detection and removal or modification. Any failure or delay in moderation does not constitute a breach of contract nor does it grant entitlement to damages of any kind.

5. Multiplayer Mode

When using the "Multiplayer" features, the user agrees to and understands the following:

• In-game Data Sharing: Upon joining a multiplayer room, your username (or a username composed of the first four characters of the user's ID "Player-XXXX") and your real-time score will be visible to other participants in the same room.
• Room Retention and Local Data: The created room code is temporarily saved in the browser's local storage (Local Storage) to allow re-entry in case of accidental disconnection. To ensure server efficiency, multiplayer rooms and the data contained within them are automatically deleted 1 hour after creation.
• Conduct: The user agrees not to intentionally disrupt or sabotage the gaming experience of other users.

6. Third-Party Services

The game utilizes services provided by third parties that govern the processing of your data:

• Google Firebase: Used for authentication (Firebase Auth) and for saving data and multiplayer rooms (Firestore).
• Iubenda: Used for managing Cookie Policy, Privacy Policy, and user consent.

7. Intellectual Property

All intellectual property rights relating to the game "Swinging Cat", including but not limited to source code, gameplay mechanics, interface design, graphics (e.g., cat assets, ropes), music, and sound effects, are the exclusive property of the game's creator or respective licensors. It is strictly prohibited to copy, modify, distribute, sell, or reverse engineer any part of the Service.

8. Limitation of Liability ("As Is")

The game is provided "AS IS" and "AS AVAILABLE". We do not guarantee that the service will be uninterrupted, error-free, secure, or free from viruses.

To the maximum extent permitted by applicable law, we disclaim all liability for any direct, indirect, incidental, or consequential damages resulting from:

• The inability to access or use the game.
• Any loss of data, scores, multiplayer rooms, or accounts.
• Unauthorized access to servers or data contained therein.

9. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the game (including the deletion of inactive rooms and scores) at any time without prior notice. We also reserve the right to update these Terms; continued use of the game following such changes constitutes acceptance of the new Terms.

10. Account Deletion

Registered users can request or independently execute the permanent deletion of their account via the designated button in the Settings panel ("Delete Account"). This operation will irreversibly remove all personal records, access data, and presence on leaderboards.
